The duty of candour sets out specific requirements providers must follow when things go wrong with care and treatment.

This includes informing people about the incident, providing reasonable support, providing truthful information and an apology.

How does duty of care relate to duty of candour? The duty of care is a legal obligation that requires individuals to take reasonable steps to protect others from harm. The duty of candour refers to the requirement for healthcare professionals to be honest with patients about any mistakes or harm. To do this, employees should take reasonable steps such as apologise for the harm caused, regardless of fault, and be open and transparent about what has happened. By fulfilling the duty of candour, they’re fulfilling the duty of care.
Is duty of candour a legal requirement? The duty of candour applies to every health and social care provider that CQC regulates under Regulation 20 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014.
